Avoiding Unnecessary Fees When Filing Amended Schedules D, E, or F And An Amended List of Creditors

When filing the amended schedules D, E, or F with an amended List of Creditors, be sure to use the event code “Amendment-Amending Schedules D and/or E/F.” You may attach to the schedule a sheet of paper with only the new or modified creditors listed. This sheet represents the creditor matrix. Both documents may be filed using the single fee event code, “Amendment-Amending Schedules D, and/or E/ F.”

The following bankruptcy  The  following  bankruptcy  forms were recently revised:  

Notice of Available Chapters  Notice of Available Chapters  (11/12) and Statement of  Social Security Number  and Statement of Financial  and  Statement  of  Financial  Affairs (12/12).

However,   many people continue  to file the old forms and  receive deficiency notices as a result.  Be sure to submit up-to-date forms in order to avoid unnecessary deficiency notices and the potential dismissal of your case.
 

CM/ECF Reminder Regarding Chapter 7 "No Asset" Designation

ASSET REMINDER: Please remember that when filing a Chapter 7 case, the asset designation should always be set to No Asset.  If the designation is set to Asset, the program will create an incorrect notice of meeting of creditors.  The No Asset designation will be changed by the Court later as needed upon notification by the chapter 7 trustee.
 

Running Judge/Trustee/341(a) Meeting Assignment

Attorney who file petitions electronically are required to upload the creditors and run the Judge/Trustee/341(a) Meeting Assignment.  Doing so not only ensures notices are sent out timely, but also decreases processing time.

If you not, the Court will automatically run the Judge/Trustee/341(a) Meeting Assignment to all cases where creditors have been uploaded.  However, this will make it unlikely for two or more Chapter 7 cases filed concurrently to obtain the same trustee and 341(a) meeting assignment.  If you try to run the Judge/Trustee/341(a) Meeting assignment after the Court, you may be presented with an error message.  Please review your cases for a Judge/Trustee/341(a) Meeting Assignment before contacting the ECF Help Desk.
 

Avoiding Multiple Amended Schedule Fees

To avoid incurring multiple fees when filing amendments to Schedules D, E, F, and/or Creditor Matrix within the same day, be sure to include the list of the affected creditors with the amended schedule(s) in one PDF.  For example, if filing Amended Schedule F and you are adding additional creditors, include the list of additional creditors in the same PDF with the Amended Schedule.  The appropriate event code is BK - Other > Amendment - Amending Schedules D, E, F for Ch 7, 11 & 13 (fee).
 

Change a Firm Name or Address in CM/ECF

It is important the Court had your current email addresses on file.  Failing to keep your contact information up-to-date may prevent you from receiving the proper electronic notification of case activity.

To update or add an email address to your profile, please submit an email request to the ECF Support Desk at ecf_support@cacb.uscourts.gov.

To change the street address, please file a Notice of Attorney Change of Address or Law Firm for for each case.  This form can be filed on multiple cases by enclosing an additional sheet listing up to 10 cases for the same divisional office.  Once you have filed the notice, please send an email to the ECF Support Desk to advise the Court of the address change.

New Docket Event Codes

Two new docket event codes have been created for external users to submit a motion to the Court to restrict access to previously filed documents containing personal data identifiers..  The docket event codes are:

BK -- Motions/Applications>Protective Order to Restrict Access to Filed Document Containing Personal Data Identifiers (BK/AP)(motion).

AP -- Motions>Protective Order to Restrict Access to Filed Document Containing Personal Data Identifiers (BK/AP)(motion).

Electronic Filing Declaration / Electronic Filing Declaration of Authorized Signatory of Debtor

An Electronic Filing Declaration must be submitted with every petition filed electronically.  The Declaration requires a holographic (physical) signature of the debtor and the attorney.

Any subsequently filed amended petitions, schedules, statements or plans must either be filed electronically with the holographic signature of the debtor(s) or accompanied by an Electronic Filing Declaration or Electronic Filing Declaration of Authorized Signatory with holographic signatures of the debtor or the debtor's representatives.

Electronically filed petitions and/or subsequently filed documents are considered deficient and a Case Commencement Deficiency Notice (CCDN) is issued if the Electronic Filing declaration and the physical signatures are missing.

Opening an Adversary Complaint

When filing an adversary complaint, always add yourself (the attorney filing the document) as the attorney for the plaintiff.  This will ensure that proper legal representation for the plaintiff is recorded and ensure all parties are properly notified of case activity.  Never add an attorney for the defendant - the Court will enter information for the defendant's legal representation when an answer to the complaint is filed.
 

Request for Courtesy Notification

The Court has created a "Courtesy NEF" party in CM/ECF.  Attorneys are reminded that when filing a Request for Courtesy Notification, search for "Courtesy NEF" and do not add any address information to the party.  Additionally, please check the "attorney association box" to associate yourself to the case.  Following these steps ensures that you are properly notified of case activity.

FILING THE STATEMENT OF SOCIAL SECURITY NUMBER

To ensure the privacy of the Social Security Number when fifi ling bankruptcy petitions, NEVER include the Statement of Social Security Number with the petition PDF. Instead, make sure to fifi le this statement separately from the petition PDF with its specififi c event code: Statement of Social Security Number(s) Form B21 or Statement of Social Security Number(s) Form B21 (AMENDED STATEMENT).

When filing Amended Schedules D, E and F, select the event code Bankruptcy -> BK- Other– Amendment – Amending Schedules D,E,F for Ch 7, 11 &13 (fee). Please do not include any other schedules; you may attach a creditor list with only the new or amended creditor information. By using this code you will be prompted to pay the $26.00 filing fee. When amending schedules A thru I, please select the Bankruptcy-> BK- Other – Amendment -Amending Schedules D,E,F for Ch 7, 11 & 13 (fee) event code. Next, press and hold the control key and select each of the other schedules to be filed. The system will ask if the schedule is being amended and you must answer “Yes” to the question each time it appears. The question will appear once for each additional schedule being  amended. Using the correct event code will expedite case management and save money and court resources. Failure to file amended schedules properly will result in an assessment of fees.

Certificate of Credit Counseling

When filing a petition, the Certificate of Credit Counseling must be filed as a separate event code. If the certificate is not filed as a separate event code, it will be flfl agged as deficient and the case will not be discharged. In a joint petition, two certififi cates may be filed under one event code. However, the certificates still need to be filed separately from the bankruptcy petition itself.

Electronic Filing Joint Debtor Financial Management Course Update

Pleaserememberthatwhen the Financial Management Course certificate is being filed, the Financial Management Course     –   Debtor event code is to be used for single debtor cases.  The Financial Management Course – Joint Debtor is for cases with two debtors.  When selecting the Financial Management Course – Joint Debtor, CM will ask the user:  “Have you already filed the certificate for the Debtor?” Theuser must select “Yes” or “No,” then click “Next” in order to complete the filing.   If only the    jointdebtor’scertificate is being filed, “No” must be selected.
