We do our best to provide factual information in context. We believe it is important for the public to consider the total number of cases filed by attorneys and law firms in the Northern Division of the Central District of California. To demonstrate that our claims are substantiated we provide information on Chapter 7 and Chapter 13 filings from the United States Public Access to Court Electronic Records, also called PACER. These numbers may be readily and easily verified from public records. It doesn't get much easier than that.
California Business and Professions Code section 6158 ensures that attorney communications are not false, misleading or deceptive. The precise code section states:
"In advertising by electronic media, to comply with Sections 61571.1 and 6157.2, the message as a whole may not be false, misleading, or deceptive, and the message as a whole must be factually substantiated. The message means the effect in combination of the spoken word, sound, background, action, symbols, visual image, or any other technique employed to create the message. Factually substantiated means capable of verification by a credible source."
We cannot guarantee the accuracy of PACER information, though we believe it is reliable. We do not mean to imply that the volume of cases filed or handled should serve as the only metric by which one should choose a lawyer. We do not intend to indicate that number of cases filed provides a measurement of quality or service. Figures are for Northern Division of the Central District of California. Some attorneys in our region file in the San Fernando Valley Division. Those filings are not included in these statistics. Certain law firms have more than one attorney and this may factor into the number of cases filed by that firm. In addition, the volume of bankruptcy legal work performed by a law firm may include matters that do not result in a "filing." Such matters may include extensive litigation involvement, creditor representation, appellate work, or other financial distress representation.
This website is a communication. California Rule of Professional Responsibility 1-400 provides that a communication shall not contain any untrue statement. It also provides factual information must be presented fairly and in context. In particular, information on this and other attorney websites must not (among other things):
Contain any matter, or present or arrange any matter in a manner or format which is false, deceptive, or which tends to confuse, deceive, or mislead the public; or
Omit to state any fact necessary to make the statements made, in the light of circumstances under which they are made, not misleading to the public.
All information on these pages is factual, verifiable, and presented for the benefit of the legal consumer. We try hard to ensure that the facts are not presented in a misleading manner. You can access PACER data to research these facts further and we encourage legal consumers to do just that. Some attorneys are uncomfortable presenting the public with this information. We aren't.
If you have any questions or suggestions on the presentation of this information, please let us know.
